Outline:
Early Neutral Evaluation (“ENE”) is a form of Alternate Dispute Resolution recognized by Federal and Missouri and Kansas state statutes and supreme court rules, but is rarely known about or taken advantage of. It is sometimes referred to as “Arbitration Light” because it is designed to be done in an open joint setting where the attorneys and their clients have an opportunity to see and hear the opposition’s view of the facts, their asserted claims and defenses, and the evidence to prove or defend against the same, and then to receive an evaluative second opinion, in writing, by the neutral. The neutral’s opinion is non-binding and confidential. Bob will discuss the ENE process, and the advantages and disadvantages of this process during this session.
